Representation for Injured Rideshare Passengers, Drivers, and Others

A passenger may be injured by a rideshare driver’s conduct or by another motorist. People in other vehicles, pedestrians, and cyclists may also be struck by a rideshare vehicle. Drivers themselves can face substantial injuries and disputed coverage. The available claims depend on the circumstances; each situation calls for its own investigation.

We examine who caused the collision, which parties may be legally responsible, and which policies may respond. The presence of an Uber or Lyft app does not automatically establish the company’s liability or eliminate a claim. Insurance availability and legal responsibility require separate analysis.

Investigating the Collision and the Digital Trip Record

The crash report is a starting point. Photographs, video, witness accounts, vehicle damage, and roadway evidence can help explain how a collision occurred. Trip acceptance, pickup, and completion records may also help establish the driver’s activity at the relevant time.

We examine the physical evidence and trip timeline together. A dispute about the driver’s status can become a dispute about which policy applies. Preserve the records you can access, and discuss appropriate evidence-preservation steps promptly.

Tennessee Rideshare Insurance and Coverage Rules

Injured during a rideshare trip or in a collision with an Uber or Lyft driver? Insurance availability can depend on the driver’s app status, who caused the crash, and the actual policies. Identifying a rideshare vehicle is the beginning of the investigation, not proof of a particular recovery.

Transportation Network Companies and Prearranged Rides

Tennessee regulates transportation network companies, or TNCs, under Tenn. Code Ann. §§ 65-15-301 et seq. A prearranged ride begins with acceptance of a requested ride and continues until the last requesting passenger leaves the vehicle. The trip to collect the passenger can therefore matter. See § 65-15-301.

How App Status Affects Required Liability Insurance

Section 55-12-141, part of Tennessee’s Financial Responsibility Law, establishes these coverage requirements:

  • App off — no prearranged ride in progress.
Ordinary financial responsibility requirements and applicable policy terms remain relevant.
  • App on — waiting for a ride request.
Primary liability minimums are $50,000 for bodily injury or death per person, $100,000 per incident, and $25,000 for property damage.
  • Ride accepted — traveling to pickup or transporting the passenger.
At least $1 million in primary liability insurance for death, bodily injury, and property damage applies during a prearranged ride, which ends when the last requesting passenger leaves the vehicle.

Required coverage may be supplied by the driver, the TNC, or both. TNC coverage is not conditioned on a personal insurer first denying the claim; the statute also addresses missing or lapsed driver coverage. These are insurance requirements, not promised settlement amounts.

Personal Auto Exclusions and UM/UIM Benefits

Tenn. Code Ann. § 56-7-1119 permits personal-auto exclusions during app use or a prearranged ride, potentially affecting liability, UM/UIM, medical payments, and vehicle-damage coverage. An endorsement may provide coverage, so the complete policy must be examined.

A rideshare liability limit does not establish the passenger’s UM/UIM benefits. Section 55-12-141 requires compliance with § 56-7-1201, which permits written rejection or lower UM limits. Review the applicable coverage and any rejection forms. Learn more about Tennessee uninsured and underinsured motorist claims, including out-of-state policy issues.

Evidence We Examine After a Rideshare Collision

Preserve the trip receipt, ride identifier, screenshots, passenger communications, photographs, and witness details. We investigate the timeline alongside fault and the client’s injuries, and seek the relevant policies and electronic trip records.

Section 56-7-1119(f) addresses cooperation in coverage investigations, including precise app log-on and log-off times during the twelve hours before and after the crash and descriptions of coverage, exclusions, and limits. These records can help resolve disputes about which insurance applies. Coverage availability and the TNC’s own legal liability remain distinct questions.

Digital platforms also arrange freight work. Learn how we investigate Amazon Relay and other platform-dispatched truck crashes, where trucking rules and platform records must be evaluated together.

Serious Injuries Require a Personal, Detailed Approach

A fracture requiring surgery, brain injury, spinal injury, or lasting disability can affect far more than the first hospital bill. We examine medical treatment, rehabilitation, prognosis, work limitations, and future care needs, while listening to the injured person and family about the changes in daily life.

Learn about our approach to serious and catastrophic injuries and wrongful death claims. The nature of the injury informs the evidence needed; it does not guarantee a particular recovery.

Protecting Deadlines and Evaluating Settlement Offers

Tennessee personal injury claims generally have a one-year limitations period, subject to accrual rules and applicable exceptions. Insurance negotiations should not be assumed to preserve the deadline. Policy notices, proposed releases, and any UM/UIM claim should be reviewed together before settlement decisions are made.

Tennessee Rideshare Accident FAQs

Who can seek help after an Uber or Lyft accident?

Passengers, occupants of other vehicles, pedestrians, cyclists, and rideshare drivers may have claims depending on the facts. We evaluate fault, injuries, and the applicable insurance rather than assuming coverage from the rideshare company’s name.

Does a rideshare insurance limit guarantee my recovery?

No. An insurance limit is not a promised payment. The claim still depends on liability, damages, applicable coverage, exclusions, and other circumstances.

What should I preserve after a rideshare crash?

Keep the trip receipt, ride identifier, app screenshots, driver information, photographs, witness details, and insurer messages. Seek appropriate medical care and do not delay contacting an attorney because records are incomplete.

What if another driver caused the collision?

The investigation should include that driver’s liability coverage and potential uninsured or underinsured motorist benefits. A rideshare liability policy should not be assumed to pay simply because you were a passenger.

What if a policy is governed by another state’s law?

Another state’s insurance law may affect coverage and recovery rights. The policy and choice-of-law rules require individual review; the Tennessee crash location does not resolve every coverage question.
